Filing a Wrongful Death Lawsuit

The deceased in this situation is the plaintiff even though they cannot file the lawsuit themselves. The person who files the wrongful death lawsuit is often the plaintiff's closest living relative. Deadlines for Filing a Medical Malpractice Lawsuit in Toronto
Your lawyer for family issues must file the wrongful death suit within three years of the deceased’s untimely death. The statute of limitations is the same for both adult and child victims.
It’s also important to note that Toronto requires you to formally notify the focus of your lawsuit that you intend to file the malpractice case. This notice must be given at least 90 days before the lawsuit is filed.
The state of Toronto requires that the defendant must be informed of:
- The legal basis of the claim
- The type of loss sustained
- The nature of the injuries suffered
Also, if you give notice less than 90 days before the statute of limitations runs out, an additional 90 days will be added on to your time limit to file.
